Terms of Service

These Terms of Service ("Terms") govern your use of the livespeech.ai service (the "Service") provided by DrawDream Inc. ("Company", "we"). By registering for or using the Service, you agree to these Terms.
1. The Service
The Service is a cloud-based product in which an AI voice agent automatically answers calls and performs tasks such as booking, information, and customer management (CRM) on behalf of business customers ("Customers"). We may improve or modify the Service's features.
2. Accounts and Registration
- You register via Google Sign-In and must provide accurate, current information.
- You are responsible for keeping your credentials secure and for all activity under your account.
3. Customer Responsibilities — Call Recording and Consent
The Service may record calls and process voice and content using AI. The Customer represents and warrants that it will:
- Lawfully obtain from callers all notices and consents required for call recording and AI processing under applicable law (Korea's Protection of Communications Secrets Act; Canada's Criminal Code consent requirements; and US state call-recording laws such as California's, some of which require the consent of all parties to the call);
- Act as the data controller for Caller personal information; and
- Ensure that its use of the Service does not violate applicable law.
If the Company suffers loss (including third-party claims) due to the Customer's breach of these obligations, the Customer will indemnify and hold the Company harmless.
4. Fees and Billing
- The Service comprises subscription plans plus usage-based overage charges. Payments are processed through PortOne and Toss Payments for customers in Korea, and through Stripe for customers in the United States and Canada.
- Fees renew automatically, and applicable taxes may be added to listed amounts.
- On non-payment, we may suspend the Service or terminate the agreement.
- Cancellations, refunds, and withdrawal of purchase are governed by applicable law and our Refund Policy (livespeech.ai/refund).
5. Third-Party Services
The Service relies on third-party services such as telephony carriers and AI processing providers. We are not liable for interruptions or failures of those third-party services to the extent they are beyond our reasonable control.
6. Availability and Suspension
We strive to provide the Service reliably but do not guarantee uninterrupted availability unless a separate Service Level Agreement (SLA) applies. We may suspend all or part of the Service for maintenance, faults, legal reasons, or similar causes.
7. Intellectual Property
All rights in the Service and related software belong to the Company. The Customer retains rights in the content it inputs or generates (configuration, call data, etc.) and grants the Company the license necessary to process such content to provide the Service.
8. Disclaimer and Limitation of Liability
The Service is provided "as is". To the maximum extent permitted by law, we disclaim all express and implied warranties.
To the extent not prohibited by mandatory law, the Company's aggregate liability is limited to the total fees paid by the Customer to the Company in the 12 months preceding the event giving rise to liability. We are not liable for indirect, special, or consequential damages. Rights guaranteed by mandatory consumer-protection law are not limited by this section.
9. Term and Termination
You may stop using the Service and terminate at any time. If you breach these Terms, we may terminate after notice (or without notice in urgent cases). On termination, data is deleted in accordance with the Privacy Policy.
10. Changes to These Terms
We may change these Terms and will announce the effective date and the changes within the Service. Continued use after the change constitutes acceptance of the revised Terms.
11. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Korea. Disputes relating to these Terms or the Service are subject to the court of competent jurisdiction under the Korean Civil Procedure Act as the court of first instance (with mandatory consumer-jurisdiction rules, such as a consumer's place of residence, taking precedence). For users in Canada and the United States, mandatory local consumer-protection rights are preserved.
12. Miscellaneous
If any provision of these Terms is held invalid, the remaining provisions remain in effect. We are not liable for failure to perform due to force majeure such as natural disasters.
